Present:
Mayor Bruce Ledford, Council Member Eric McGill, Council Member Lindsay Watt, Council Member Matt Francis, Council Member Janet Mott, Council Member Chris Smiley and City Attorney Tom Kieklak
A) Mayor Bruce Ledford called a City Council Meeting of the City of Elkins at 7:00 p.m.
B) Bryan Watts led the invocation.
C) Mary Cope led the Pledge of Allegiance.
D) City Clerk, Delia Foster, took roll: Council Member Lindsay Watt, Cour Member Eric McGill, Council Member Janet Mott, Council Member Chris Smiley, and Council Member Matt Francis were present Council Member Jeff Plumlee was absent.
E) Approval of Minutes:
Approval of July 16, 2020 City Council Meeting Minutes:
Council Member Francis made a motion to approve the City Council Meeting Minutes of July 16, 2020 as presented. Council Member Mott seconded the motion. Roll Call: (5/0) Motion Carried

A) Approval of Planning Committee Member Application – Mary Cope:
Council Member Smiley made a motion to approve the appointment of Mary Cope to the Planning Committee. Council Member Francis seconded. A voice vote was called and all voted “aye”, the issue passed unanimously.
B) Approval of Public Library Board Member Application – Kathie Battenfield:
Council Member Francis made a motion to approve the appointment of Kathie Battenfield to the Public Library Board. Council Member Mott seconded. A voice vote was called and all voted “aye”, the issue passed unanimously.
Motion to Suspend the Rule:
Council Member Francis made a motion to suspend the rule. Council Member Smiley seconded the motion. Roll Call: (5/0) Motion Carried
C) Ordinance 09-17-2020A: To Permit the Sale of Alcohol by the Drink in the City of Elkins:
City Attorney, Tom Kieklak, read Ordinance No. 09-17-2020A by title only.
Council Member Watt made a motion to approve Ordinance 09-17-2020A. Council Member Francis seconded. Roll Call: (5/0) Motion Carried
Council Member Francis made a motion to approve the emergency clause of Ordinance 09-17-2020A. Council Member Smiley seconded the motion. Roll Call: (5/0) Motion Carried
D) Ordinance 09-17-2020B: To Waive Competitive Bidding in Order to Purchase a Work Truck for the Elkins Fire Department:
City Attorney, Tom Kieklak, read Ordinance No. 09-17-2020B by title only.
Council Member Mott made a motion to approve Ordinance 09-17-2020B. Council Member Watt seconded. Roll Call: (5/0) Motion Carried
E) Resolution 2020-9 Authorizing the Sale of Surplus Property and Other Equipment:
Council Member Mott made a motion to approve Resolution 2020-9 authorizing certain equipment be disposed of as surplus property. Council Member Watt seconded. A voice vote was called and all voted “aye”, the issue passed unanimously.
F) Resolution 2020-10 Authorizing Certain City Officials/Employees to Execute Checks and Drafts on Specified Elkins District Court Bank Accounts of the City of Elkins:
Council Member Watt made a motion to approve Resolution 2020-10. Council Member Smiley seconded. A voice vote was called and all voted “aye”, the issue passed unanimously.
I) Committee of the Whole:
Tammy Knowles and other various residents of Walnut St. voiced objections and addressed concerns regarding a rehabilitation house which would house approximately four (4) men being located at 1360 Walnut.
J) Adjourn – Council Member Francis made a motion to adjourn at 7:39 p.m. Council Member Watt seconded the motion. A voice vote was called and all voted “aye”, the issue passed unanimously.
