CITY OF ELKINS, WASHINGTON COUNTY, ARKANSAS
AN ORDINANCE TO WAIVE COMPETETIVE BIDDING IN ORDER TO PURCHASE A WORK TRUCK FOR THE ELKINS FIRE DEPARTMENT AND SUCH OTHER ACTION AS IS NECESSARY IN CONNECTION THEREWITH.
WHEREAS, the City Council of the City of Elkins has been advised that the Elkins Fire Department is in need of a work truck and has investigated the purchase of a 2021 Dodge Ram 3500 Regular Cab Chassis 4×4 Diesel and has been advised that in order to obtain the best equipped vehicle to fit the needs of the Elkins Fire Department, competitive bidding should be waived so that the work truck can be purchased expeditiously at the best price; and
WHEREAS, the Mayor and City Council of the City of Elkins has received a proposal from Lewis Chrysler Dodge Jeep Ram in the amount of $47,965.00 to purchase a 2021 Dodge Ram 3500 Regular Cab Chassis 4×4 Diesel for the City of Elkins Fire Department: and
WHEREAS, the purchase of the 2021 Dodge Ram 3500 Regular Cab Chassis 4×4 Diesel is in the best interest of the City of Elkins as it provided additional necessary services that are crucial for the growth and continued health and safety of Elkins; and
WHEREAS, The City Council has been advised by staff that exceptional circumstances exist and the bidding procedure is not feasible or practical because Lewis Chrysler Dodge Jeep Ram is the only auto dealer available to be able to provide the best price for the appropriately outfitted work truck for the Elkins Fire Department, and no other dealership submitted bids on the specified vehicle after being invited to do so.
WHEREAS, it is in the best interest of the citizens of Elkins to best use the resources of the City and provide a way to reliably and efficiently purchase a work truck for the Elkins Fire Department and to best promote the health, safety and welfare of the citizens of Elkins, by waiving competitive bidding as herein described.
NOW, THEREFORE, BE IT HEREBY ORDAINED by the City Council of the City of Elkins Arkansas:
Section 1. That pursuant to state law and applicable city ordinances, the City Council hereby waives the requirements of competitive bidding for the work truck described herein and in the attached proposal.
Section 2. That all ordinances or resolutions or orders, and parts thereof, in conflict with this ordinance are hereby repealed to the extent of such conflict.
Section 3. That in the event that any section, paragraph, subdivision, clause, phrase, or other provision or portion of this Ordinance be adjudged invalid or unconstitutional, the same
shall not affect the validity of this Ordinance as a whole, or any part or provision, other than the part so decided to be invalid or unconstitutional, and the remaining provisions of this Ordinance shall be construed as if such invalid, unenforceable or unconstitutional provision or provisions had never been contained herein,
