AN ORDINANCE DETERMINING FEES AND CHARGES RELATED TO TITLE 11 OF THE ELKINS MUNICIPAL CODE REGULATING ISSUANCE OF PERMITS, INSPECTION FEES AND FEES RELATED TO DEVELOPMENT OF REAL PROPERTY AND DECLARING AN EMERGENCY TO EXIST.
WHEREAS, EMC Title 11, Chapters 11.04, 11.16 and 11.20 determine fees for issuance of permits, inspections, filing of land use documents and related purposes.
WHEREAS, EMC, Title 11, Chapters 11.04 and 11.16 refer to the most recent petmit/fee resolution/ordinance adopted by the City Council and Chapter 11.20 has an exhibit setting forth the various fees, all of which has created some confusion for city staff and individuals seeking permits and paying fees.
BE IT ORDAINED BY THE CITY COUNCIL OF ELKINS, ARKANSAS, That,
Section 1: Exhibit 04-21-2011A as attached hereto, from the effective date hereof, shall be used to determine the fees for permits, inspections, document filings in relation to land use matters, and all other fees/charges set forth on the attached exhibit.
Section 2: That whenever the term “most recent permit/fee resolution/ordinance” or words of similar import are used in Chapter 11.04 and Chapter 11.16 of the Elkins Municipal Code, the attached Exhibit 04-21-2011 A shall be the “most recent permit/fee resolution/ordinance”.
Section 3: That Sections 11.20.01 through 1 1.20.08 of Chapter 11.20 of Title 11 of the Elkins Municipal Code are hereby amended by deleting the phrase “Exhibit A hereto” and replacing such phrase with the following words, ‘(Exhibit 04-21-2011A as attached to Ordinance No. 04-21-2011A.”
Section 4: That in order to immediately bring a halt to confusion in this area of interaction between the City, its residents and individuals doing business in the City, and to preserve and protect the health, safety and welfare of the citizens it is hereby declared that an emergency exists and this ordinance shall be immediately effective upon its passage and approval.
