AN ORDINANCE AMENDING ELKINS MUNICIPAL CODE TITLE 10, CHAPTER 10.08, SECTION 10.08.02 WATER RATES AND SECTION 10- 08.03 SEWER RATES.
WHEREAS, questions have been raised and confusion may exist in the minds of some utility customers of the City concerning the proper rate for water usage and the proper rate for sewer usage.
BE IT ORDAINED BY THE CITY COUNCIL OF ELKINS, ARKANSAS, That:
Section 1: Effective with the passage of this Ordinance, Paragraph A of Section 10.08.02 of Chapter 10.08, Title 10 of the Elkins Municipal Code shall be amended to establish that the rates for water usage for customers of the Elkins’ Water and Sewer Department are as shown on Exhibit A hereto.
Section 2: Effective with the passage of this Ordinance Paragraph A of Section 10.08 .03 of Chapter 1 0.08, Title 10 of the Elkins Municipal Code shall be amended to establish that the rates for sewer usage for customers of the Elkins’ Water and Sewer Department are as shown on Exhibit A hereto.
Section 3: That the only amendment to Sections 10.08.02 and 10.08.03 are as reflected on Exhibit A hereto, none of the text in such sections is being amended and those Sections, except as expressly addressed on Exhibit A, are ratified and confirmed.
Section 4: All ordinances, parts of ordinances and any provision in the Elkins Municipal Code in conflict herewith are repealed to the extent of such conflict.
Section 5: A Public Hearing on the rates/charges set forth on Exhibit A hereto is set for 6:30PM on Thursday, April21, 2011, and thereafter this Ordinance shall again be considered and voted on at the City Council meeting scheduled for 7:00PM that same day.
