AN ORDINANCE AMENDING 7.52.04 OF CHAPTER 7.52 OF THE ELKINS MUNICIPAL, DECLARING AN EMERGENCY TO EXIST, AND FOR RELATED PURPOSES
WHEREAS, Ordinance 08-18-2011-B adopted October 20, 2011, established the procedure for posting of Bylaws, Resolutions and Ordinances of the City as opposed to publishing those enactments in a newspaper;
WHEREAS, Ordinance 08-18-2011-B also determined the five (5) public places where such enactments would be posted;
WHEREAS, Ordinances 08-18-2011-B was subsequently codified as Section 7.52.01 through 7.52.04 of the Elkins Municipal Code;
WHEREAS, one of the locations listed at Section 7.52.04 as one of the five public places has ceased to do business as a commercial concern and therefore the enactments posted there are less likely to be seen by members of the public.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF ELKINS, ARKANSAS, That:
SECTION 1: From and after the effective date of this Ordinance Section 7.52.04 of the Elkins Municipal Code shall read as follows:
7.52.04 Public Places
The most public places in Elkins, Arkansas, for purposes of posting all bylaws, notices, resolutions and ordinances are hereby determined to be:
- Elkins Post Office
- Elkins City Hall
- Elkins Water Department
- Elkins Senior Center
- Farmer’s Co-Op (2049 N. Twin Oaks Drive)
Section 2: All other Sections of Chapter 7.52 are ratified and confirmed.
Section 3: To fully inform the public it is necessary to post enactments of the City Council at the most public places in the City; therefore in order to promote and preserve the safety, welfare and peace of the citizens of Elkins, an emergency is hereby declared, therefore this Ordinance shall be effective immediately upon its passage and approval.
