AN ORDINANCE AMENDING SECTION 3.04.04 A. ADMINISTRATIVE APPROVAL, OF THE ELKINS MUNICIPAL CODE AND OTHER MATTERS RELATED THERETO

            WHEREAS, Elkins Municipal Code Title 3, Chapter 3.04, Section 3.04.04 sets forth requirements for authorization of purchases of goods and/or services;

            WHEREAS, the authorization process is keyed to the cost of goods and/or services being purchased;

            WHEREAS, the monetary limits were adopted approximately ten years ago and as a result of the increased costs of most goods/and/or services required to operate the City, those limits have become a burden on the efficient operation of the City and adds to the Council agenda for approval of necessary and routine purchases.

            NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF ELKINS, ARKANSAS, That:

            SECTION 1:  From and after the effective date of this ordinance Section 3.04.04 A. 3. shall read as follows:

“3. The City Council shall, from time to time, adopt a resolution setting the cost limit for each purchase of goods or services which purchase must be reviewed and approved by the City Council.”

            SECTION 2:  A resolution adopted to set the cost limit for each purchase of goods or services which requires specific approval by the City Council may be combined with a budget resolution or may be solely for the purpose of determining such cost limit threshold.

            SECTION 3:  Each resolution adopted to set the cost limit for each purchase of goods or services which purchase requires the approval of the City Council shall continue in effect until either:

  1. Adoption of another resolution adopted to set the cost limit for each purchase of goods or services which purchase requires the approval by the City Council; or,
  2. The end of the term of the Mayor serving at the time the latest resolution was adopted to set the cost limit for each purchase of goods or services which purchase requires the approval by the City Council;

WHICHEVER occurs first.

            PASSED AND APPROVED this __21st_ day of __January__, 2016.
