AN ORDINANCE REPEALING ORDINANCE 01-18-20078 AND PROVIDING FOR THE POSTING OF BYLAWS RESOLUTIONS, AND ORDINANCES OF THE CITY OF ELKINS, ARKANSAS, AND DETERMINING FIVE (5) OF THE MOST PUBLIC PLACES IN ELKINS, ARKANSAS, FOR THE PURPOSE OF POSTING ORDINANCES, BYLAWS, RESOLUTIONS, AND NOTICES.

WHEREAS, the City of Elkins is required by Arkansas Code Annotated Section 14-55- 206 to either publish or to post written or printed notice of certain bylaws and ordinances;,

WHEREAS, there is every indication that after the 30th day of September 2011, there will be no newspaper general office in Elkins and no newspaper published in Elkins;

WHEREAS, the most effective way of notifying the citizens and residents of Elkins of bylaws, resolutions, and ordinances of a general or permanent nature and specifically those imposing any fine, penalty or forfeiture is to post same in public places within the City of Elkins.

WHEREAS, The City Council of Elkins, Arkansas is required to designate five (5) of the most public places in Elkins, Arkansas, which shall be utilized for the aforesaid posting, and

WHEREAS, the City Council needs to give specific guidelines concerning the posting of bylaws, resolutions, notices, and ordinances and specifically those imposing any fine, penalty or forfeiture.

NOW, IT IS HEREBY DETERMINED, ENACTED AND ORDAINED BY THE CITY COUNCIL OF ELKINS, ARKANSAS,

SECTION 1: That all laws, bylaws, resolutions, notices, or ordinances and specifically those imposing any fine, penalty or forfeiture of the City of Elkins, Arkansas, adopted or enacted after the 20th day of October, 2011, , shall be posted in the five (5) hereinafter designated public places for a period of not less than thirty (30) calendar days.

SECTION 2: Such posting, as aforesaid, shall occur within one hundred twenty hours (120) hours of adoption or enactment, shall be done in a manner which provides reasonable protection for the documents against the elements, the posting should ensure that the full text of the resolution. bylaw, notice or ordinance is visible to the public or that the full title and first page of the text along with the signature page thereof is visible with written advice to the effect that a complete copy of the entire text of the bylaw, resolution, notice, or ordinance is available to the public at the office of the City Clerk in Elkins’ City Hall, 1874 Stokenbury Road, Elkins, AR during regular office hours. However, if there are civil or criminal fines, penalties, forfeitures or levies the pages containing information on such civil or criminal fines, penalties, forfeitures or levies must be visible with written advice to the effect that a complete copy of the entire text of the bylaw, resolution, notice or ordinance is available to the public at the office of the City Clerk in Elkins’ City Hall, 1874 Stokenbury Road, Elkins, AR during regular office hours.

SECTION 3: That the official or employee of the City of Elkins who posts each such law, bylaw, resolution, notice or ordinance and specifically those imposing any fine, penalty or forfeiture shall record the date of posting, the date of removal, and the locations where posted in a permanent Record to be maintained by the City Clerk/Office Manager.

SECTION 4: That the most public places in Elkins, Arkansas, for purposes of posting all bylaws, notices, resolutions and ordinances are hereby determined to be:

1) Elkins Post Office

2) Elkins City Hall – 1874 Stokenburv Road, Elkins, Arkansas (Inside in the receptionist area).

3) Elkins Water Department – 1874 Stokenbury Road, Elkins, Arkansas (Inside the Water/Sewer office).

4) Elkins Senior Center

5) Elkhorn Service Station

SECTION~: Inasmuch as the White River Valley News has closed its office and been absorbed by the Madison County Record and the location of City Hall and the Water/Sewer Department and the District Court have changed, it is necessary to repeal Ordinance 01-18- 2007B and start anew.
