    Public Hearing Minutes

    09/05/2019

    A public Hearing was held for the purpose of Rezoning 92 acres from R-1 to R-1/PUD.

    Meeting called to order at 7:00 PM by Chairman Chris Smiley.

    Juliet Richey with Garver presented the plans with power point and verbal explanation of each aspect of PUD, (See attached plan and handbook)

    • Approximately 241 Lots
    • Approximately 20 acres of green space
    • 2 Connections to Highway 16
    • 2 Connections into Stokenbury farms Phase 1
    • 5 stub outs to adjacent properties

    Many citizens voiced concerns

    1) Status of city’s current sewer system and possible impact of more homes being connected

    2) Possible traffic increase on Stokenbury road, Questions about traffic study and possibility of a traffic light.

    3) Privacy of existing residence on Richland creek with possibility of 2 story homes built in new phase.

    4) Barbara King had researched PUDs and was unsure if this is truly what Elkins needs.

    9/05/2019

    Planning meeting called to order at 8:20 PM by Chairman Chris Smiley.

    Members present: Chris Smiley, Preston Griffith, David Harrellson, Jerry Barnett, Troy Reed.

    Preston Griffith made a motion to approve minutes from 8/19/2019 Public hearing and Planning meeting. Second by David Harrellson, All in favor.

    Old Business

    • Dilan Foster lot split tabled at last meeting for concerns of driveway easement not being identified on plat, New plat submitted with driveway easement clearly identified.

    David Harrellson made motion to approve lot split, Troy Reed second, All in favor. (#5-19)

    New Business

    1) Roberta Nickells requested lot line adjustment of previous lot split.

    Troy Reed Made motion to approve lot line adjustment, Jerry Barnett second, All in favor. (#6-19)

    2) Stokenbury Farms Phase 2 request to rezone from R-1 to R-1 PUD,

    David Harrelson made a motion to unanimously approve and forward a recommendation of approval of this PUD/Rezoning to the City Council with the below conditions.  Troy Reed seconded the motion; All in members in favor (roll call vote).

    1. The proposed development must proceed through the City’s Subdivision Process and is subject to all subdivision and zoning regulation not otherwise noted in this PUD Submittal.
    2. This approval shall generally conform to the PUD Document and Subdivision Layout and Phasing Plan provided by the applicant and attached to this staff report. Minor deviations in the layout and phasing are expected and acceptable as the design work and project engineering are finalized in Preliminary Plat.
    3. The parking area proposed for the park shall be hard surface pavement, designed and constructed per standard engineering methods (to be approved by the city). The parking shall be completed with Phase 2.
    4. Phasing of the Reconfiguration Areas of Stokenbury Farms (Original) Detention Ponds shall be determined at Preliminary Plat.
    5. Phasing of greenspace in Area 4 (11.28 acres) shall be determined at Preliminary Plat.
    6. Page 5 of the PUD booklet submitted by Rausch Coleman for this project shall further clarify specifically which streets on this PUD concept plan will not contain on-street parking facilities. This should be re-written in a way that is conceptually binding even if minor layout adjustments occur between PUD approval and Preliminary Plat approval for the appropriate phase.
