Present: Mayor Bruce Ledford, Council Member Eric McGill, Council Member Matt Francis, Council Member Mary Cope, Council Member Chris Smiley, Council Member Jeff Plumlee, Council Member Lindsay Watt and City Attorney Tom Kieklak
A) Mayor Bruce Ledford called a City Council Meeting of the City of Elkins at 7:00 p.m.
B) Chris Smiley led the invocation.
C) Jim Cope led the Pledge of Allegiance.
D) City Clerk, Delia Foster, took roll: Council Member Eric McGill, Council Member Matt Francis, Council Member Mary Cope, Council Member Chris Smiley, Council Member Lindsay Watt, and Council Member Jeff Plumlee were present.
E) Approval of Minutes:
Approval of July 21, 2022 City Council Meeting Minutes:
Council Member Cope made a motion to approve the City Council Meeting Minutes of July 21, 2022. Council Member Francis seconded the motion. Roll Call: (6/0) Motion Carried
F) Committee–of-the–Whole:
A) Council Member Francis gave notice of an all committees meeting to be held November 11, 2022 at 7PM at the Community Center.
B) Council Member Francis made a motion to add Committee Reports after New Business on the Agenda. Council Member Smiley seconded the motion. A voice vote was called and all voted “aye“, the issue passed unanimously.

I) New Business
Sports Complex;
Troy Reed and Stacy Plumlee informed the council of many good things happening with the Sports Complex (applied for AED/1st Aid Kit, dirt mixture for fields ordered, ad banner promotions, Facebook page being created, in talks with U of A for assistance with fields). The Coordinator position to be advertised within a few weeks.
Council Member Lindsay Watt questioned the forming of the “sports complex committee” as it had not been approved through the council. Heated discussion took place regarding the Parks Committee and the creation of the Sports Complex Committee.
Council Member Smiley made a motion to table the discussion of the Sports Complex Committee until the Parks Committee and Stacy Plumlee and others wishing to be on the Sports Complex Committee could meet. Council Member Watts seconded the motion. A voice vote was called and all voted “aye“, the issue passed unanimously.
A) Ordinance No. 2022-5– An Ordinance to Adjust Monthly Water Rates and Fees in the City of Elkins, Arkansas:
Council Member Francis made a motion to read Ordinance No. 2022–5 by title only. Council Member Smiley seconded the motion. Roll Call: 6/0 Motion Carried
City Attorney, Tom Kieklak, read Ordinance No. 2022–5 by title only.
Council Member Smiley made a motion to approve Ordinance No. 2022–5. Council Member Plumlee seconded. Roll Call: (6/0) Motion Carried
B) Resolution 2022-8 – Introducing an Ordinance to Adjust Sewer Rates and Fees for the City of Elkins and Setting a Public Hearing Pursuant to Ark Code Ann. $14-235-223 and Calling for the Publication of the Same:
Council Member Francis made a motion to approve Resolution 2022–8. Council Member Smiley seconded the motion. A voice vote was called and all voted “aye“, the issue passed unanimously.
C) Henard Utility Invoice Approvals to pay with ARPA Funds:
Council Member Smiley made a motion to approve the payment of $77,219.07 to Henard Utility Products for meter setters from the ARPA funds. Council Member Plumlee seconded the motion. Roll Call (6/0) Motion Carried.
D) Ordinance No. 2022-6 – Amending Regulations for Recreational Vehicles:
Council Member Francis made a motion to read Ordinance No. 2022–6 by title only. Council Member McGill seconded the motion. Roll Call: 6/0 Motion Carried
City Attorney, Tom Kieklak, read Ordinance No. 2022–6 by title only.
Council Member Francis made a motion to approve Ordinance No. 2022–6. Council Member Cope seconded. Roll Call: (6/0) Motion Carried
J) Committee Reports:
Planning Committee: Troy Reed reported that most things, with the exception of lot splits, are on hold until the situation with the Arkansas Health Department is resolved.
Water & Sewer Committee: Jim Cope reported working with Garver Engineering to add another 60hp pump in current pump station to resolve the sewer problem with Arkansas Health Department.
Parks Committee: Lynn Francis reported meetings are held on 2nd Wednesday of each month at 7PM. Currently working on 5-year strategic plan for maintenance, development, and improvement of parks and trails. Requesting to add line items in next year‘s budget.
Library Board: Eve Owens reported the library board have resumed quarterly meetings, and the next meeting will be held on October 11, 2022 at 6PM. Currently working to repair the A/C in the community room and general maintenance.
K) Adjourn
Council Member Francis made a motion to adjourn at 8:22 p.m. Council Member Cope seconded the motion. A voice vote was called and all voted “aye“, the issue passed unanimously.
