CITY OF ELKINS, WASHINGTON COUNTY, ARKANSAS 

AN ORDINANCE TO AMEND SECTION 12.10.02 OF THE ELKINS MUNICIPAL CODE IN ORDER TO ESTABLISH REGULATIONS FOR OCCUPANCY OF RECREATIONAL VEHICLES AT BUNCH PARK IN THE CITY OF ELKINS; AND FOR OTHER PURPOSES

WHEREAS, it has come to the attention of the City of Elkins that there is a need to adjust the usage fee and establish regulations for occupancy of recreational vehicles, also known as campers, RV’s, or travel trailers, all hereinafter collectively referred to as RV‘s” within the city limits of Elkins, Arkansas

WHEREAS, the City Council has been advised that there is a need to adjust the campsite usage fees due to reflect an increase of utility cost and to protect the public, as extended occupation of RVs, not meant for longterm habitation, is unsafe and a potential risk to public health and contrary to the best use of the park resources, and 

WHEREAS, after thorough review, the City Council has determined that the approval of the proposed amendments, as described herein, to Section 12.10.02 of the Municipal Code is in the best interest of, and benefit to the citizens of the City of Elkins

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Elkins, Arkansas, as follows

Section 1. 

Section 12.10.02 of the Elkins Municipal Code is hereby amended as follows

a. An Elkins resident or guest of a resident who wishes to occupy their RV for a period of fourteen (14) days or less at the Bunch Park Campsite, or public property where not otherwise prohibited, must apply for and receive an RV occupancy parking permit at Elkins City In no event shall any RV occupy a space at Bunch Park for longer than fourteen (14) days.

b. Usage Fees

$30.00 for NonSpecial Event Days 

$50.00 for Special Event Days, which shall include but are not limited to University of Arkansas game days and Bikes Blues & BBQ. The Mayor will designate other special event days and shall advise council of any such additions as soon as practicable

c. The application shall be reviewed by the City Clerk or the Clerks designee, who shall consult with other city personnel as necessary. If the application is denied, the City Clerk shall give the reason(s) for the denial in writing in the space provided on the application

Section 3. All City of Elkins ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict

Section 4. In the event that any section, paragraph, subdivision, clause, phrase, or other provision or portion of this Ordinance shall be adjudged invalid or unconstitutional, the same shall not affect the validity of this Ordinance as a whole, or any part or provision, other than the part so decided be invalid or unconstitutional, and the remaining provisions of this Ordinance shall be construed as if such invalid, unenforceable or unconstitutional provision or provisions had never been contained herein
