CITY OF ELKINS, WASHINGTON COUNTY, ARKANSAS
AN ORDINANCE AMENDING SECTION 7.52.04 “PUBLIC PLACES” OF THE ELKINS MUNICIPAL CODE.
WHEREAS, the City of Elkins has adopted regulations for providing public notice of all bylaws and ordinances codified in Section 7.52.04 of the Elkins Municipal Code pursuant to A.C.A. $ 14–55–206; and
WHEREAS, it has come to the attention of the City Council of Elkins that Section 04 of the Elkins Municipal Code must to be amended in order to update the posting locations of all bylaws and ordinances within the City of Elkins; and
WHEREAS, after thorough review, the City Council has determined that the approval of the proposed amendment to Section 7.52.04 is in the best interest of, and a benefit to the citizens of Elkins in order to provide proper notice by public posting in accordance with Arkansas State Law.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELKINS, ARKANSAS:
Section 1, Section 7.52.04 of the Elkins Municipal Code is hereby amended as follows:
The most public places in Elkins, Arkansas, for purposes of posting all bylaws, notices, resolutions and ordinances are hereby determined to be:
- Elkins Post Office
- Elkins City Hall
- Elkins District Court
- Elkins Senior Center
- Farmer‘s Co-Op (2049 N. Twin Oaks Drive)
Section 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed to extent of such conflict.
Section 3. In the event that any section, paragraph, subdivision, clause, phrase, or other provision or portion if this Ordinance shall be adjudged invalid or unconstitutional, the same shall not affect the validity of this Ordinance as a whole, or any part or provision, other than the part so decided to be invalid or unconstitutional, and the remaining provisions of this Ordinance shall be construed as if such invalid, unenforceable or unconstitutional provision or provisions had never been contained herein.
