ORDINANCE NO. 10-17-2019 CITY OF ELKINS, WASHINGTON COUNTY, ARKANSAS AN ORDINANCE ACCEPTING THE ANNEXATION OF CERTAIN LANDS INTO THE CITY OF ELKINS, WASHINGTON COUNTY, ARKANSAS.
WHEREAS, Timothy C. Gabbard and Donna M. Gabbard own the following described property situated in Washington County, Arkansas, to-wit:
PARCEL 001-11129-000: A PART OF THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 35, TOWNSHIP 16 NORTH, RANGE 29 WEST, WASHINGTON COUNTY, ARKANSAS, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS, TO-WIT: BEGINNING AT AN EXISTING PIPE MARKING THE SOUTHWEST CORNER OF SAID FORTY ACRE TRACT AND RUNNING THENCE ALONG THE WEST LINE THEREOF NO2°26’16’E 429.00′, THENCE LEAVING SAID WEST LINE N68°07’16”E 100.72′, THENCE N65°52’16”E 100.27′, THENCE N67°57’16″E 100.69′, THENCE N66°22’16’E 100.40′, THENCE N32°46’16”E 106.94′, THENCE N44°29’16’E 158.90′, THENCE N70°18’16″E 275.28′, THENCE SO2°45’36” W 914.32′, THENCE N87°37’36″W 773.58′, TO THE POINT OF BEGINNING, CONTAINING 11.92 ACRES, MORE OR LESS. SUBJECT TO ALL EASEMENTS AND RIGHTS-OF-WAY OF RECORD.
WHEREAS, by order of annexation of the County Court of Washington County, Arkansas dated September 9, 2019, and filed for record September 9, 2019, the above-described real property was annexed into the City of Elkins, Washington County, Arkansas;
WHEREAS, the property is adjacent and contiguous to the present city boundary line for the City limits of Elkins, Washington County, Arkansas as shown on the Parcel Map attached to this Ordinance and marked as Exhibit “A”.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF ELKINS, ARKANSAS:
Section 1: That the above-described real property is hereby annexed into the City of Elkins, Washington County, Arkansas, pursuant to Ark. Code Ann. $14-40-601, et seq.
Section 2: That this ordinance shall be mailed to the recorder of deeds of Washington County, Arkansas, as well as the County Clerk of Washington County, Arkansas, who shall certify one copy of the plat of the annexed territory and one copy of the Order of the Court and the resolution or ordinance of this Council and forward a copy of each document to the Secretary of State and to the Director of the Tax Division of the Arkansas Public Service Commission to show the above described property now located within the City of Elkins, Washington County, Arkansas.
