AN ORDINANCE TO PERMIT THE CITY OF ELKINS TO CONDUCT BUSINESS WITH GUNNAR WATT, HUSBAND OF ELKINS CITY COUNCIL MEMBER, LINDSAY WATT, EMPLOYED BY WILSON GUN SHOP, INC. TO CONTINUE TO PURCHASE ITEMS FOR THE ELKINS POLICE DEPATMENT AND FOR OTHER PURPOSES

WHEREAS, Gunnar Watt, who is married to a City of Elkins city council member, is employed with Wilson Gun Shop, Inc., which has offered to provide the Elkins Police Department with guns and other equipment to the police department to perform their necessary duties; and,

WHEREAS, the City Council has determined that because of the exemplary quality and reasonably priced equipment that has been offered by Wilson Gun Shop, Inc., it is in the best interest of the City of Elkins to purchase police guns and equipment from Wilson Gun Shop, Inc.; and,

WHEREAS, having specifically recognized that the husband of city council member Lindsay Watt is employed by Wilson Gun Shop and the City Council, with Mrs. Watt abstaining, approves of conducting business with Wilson Gun Shop.

NOW THEREFORE, BE IT ORDAINED, by the City Council of the City of Elkins, as follows:

Section 1. Wilson Gun Shop, Inc., is permitted to continue providing services such as guns and other tactical equipment and necessarily related services to the City of Elkins, at such rates as the City of Elkins has been accustomed to remitting for such services and products and other equipment. The City Council shall monitor such expenditures though the regular reporting of the City Administration. This Permission shall continue to this extent until such time as this City Council should alter it.

Section 2. Severability Provision. In the event that any section, paragraph, subdivision, clause, phrase, or other provision or portion of this Ordinance shall be adjudged invalid or unconstitutional, the same shall not affect the validity of this Ordinance as a whole, or any part or provision, other than the part so decided to be invalid or unconstitutional, and the remaining provisions of this Ordinance shall be construed as if such invalid, unenforceable or unconstitutional provision or provisions had never been contained herein.
