AN ORDINANCE ESTABLISHING PARKING RESTRICTIONS TO PROHIBIT BLOCKING A UNITED STATES POSTAL SERVICE MAILBOX IN THE CITY OF ELKINS, ARKANSAS.

WHEREAS, it has come to the attention of the City Council of the City of Elkins, Arkansas that the obstruction of United States Postal Service mailboxes has become an ongoing problem and nuisance within in the City of Elkins; and

WHEREAS, it is necessary to establish certain parking restrictions to prohibit parking in such a way that obstructs access to such any official United States Postal Service mailbox.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ELKINS, ARKANSAS, THAT:

Section 1: Parking Blocking a Mailbox Prohibited. A person may not stop, stand or park a motor vehicle, motorcycle, motor scooter, trailer, tractor, or any other item on a city street in front of and blocking an official United State Postal Service mailbox Monday through Saturday from the hours of 8:00 a.m. until 5:00 p.m. This prohibition of parking shall not be applicable or enforced on any day that the United States Postal Service does not deliver mail such as all Federal Holidays.

Section 2: Notice of Violation. Whenever a person charged with the enforcement of this restriction to prohibit the obstruction of any official United States Postal Service mailbox, such as a City of Elkins law enforcement officer or a City of Elkins code enforcement officer, shall notify the owner or operator of such vehicle of the alleged violation by conspicuously attaching to said vehicle or delivering to the owner or operator a notice or citation clearly stating the violation charged and requiring such owner or operator to respond to charge(s) within five (5) business days after such violation.

Section 3: Civil Penalty’ for Violation.

  • Any person found to be in violation of this restriction shall be assessed a fine not to exceed $100.00 for each offense and each day of a continuous violation shall be considered a separate offense.
  • Any person who has failed to respond to a citation issued pursuant to this ordinance within five (5) business days shall receive a written notice. Such notice shall state that if the fine is not paid within thirty (30) days, a late penalty of $25.00 shall be added to the initial citation.

Section 4. All ordinances and parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict and if any part of this ordinance shall be deemed invalid, this ordinance shall be applied as if that portion never existed and such ruling shall not affect the remainder of this ordinance.
