CITY OF ELKINS, WASHINGTON COUNTY, ARKANSAS

AN ORDINANCE TO INCREASE WATER AND SEWER TAPPING FEES FOR THE CITY OF ELKINS, ARKANSAS AND DECLARING AN EMERGENCY

WHEREAS, it has come to the attention of the City Council that is it necessary to increase water and sewer tapping fees to preserve its ability to operate and continue to deliver vital services by the Elkins Water and Sewer Department; and

WHEREAS, after a public hearing was held on these proposed fees, the city council has determined that adjustments are necessary to maintain the system; and

WHEREAS, having fully reviewed the proposed fee increases, the Elkins City Council has determined that the water and sewer tapping fees should be revised and amended, as set forth herein below.

NOW THEREFORE, BE IT ENACTED, by the City Council of the City of Elkins, Arkansas;

Section 1. Sewer Tapping Fee. All sewer tap fees shall be One Thousand Dollars

($1,000.00).

Section 2. Water Tapping Fee.

  1. Water tap fees for a three quarter (3/4) inch meter shall be One Thousand Dollars ($1,000.00).
  2. Water tap fees for a one (1) inch meter shall be One Thousand Five Hundred ($1,500.00).
  3. Water tap fees for a two (2) inch meter shall be Two Thousand Five Hundred Dollars ($2,500.00)

Section 3. Reconnection Fees. There shall be a fifty-dollar ($50.00) reconnection fee.

Section 5. Any and all ordinance which are in conflict with this ordinance are repealed to the extent of the conflict and if any part of this ordinance is declared to be unconstitutional or illegal in anyway, that status shall not affect the remaining parts of this ordinance and those parts shall remain in full force and effect.

Section 6. Declaration of Emergency. It is hereby found and determined that the Elkins Municipal Code should be immediately amended in order to insure that the City of Elkins sewer department is able to fully support the water and sewer system and its operations, therefore, an emergency is declared to exist, and this Ordinance being immediately necessary to insure the proper growth and development of the City and for the preservation of the public peace, health,
safety and welfare of the citizens of Elkins, Arkansas shall become effective immediately from and after the date of its passage.
