AN ORDINANCE DESIGNATING THE OFFICIAL PRIMARILY RESPONSIBLE FOR COLLECTION OF FINES IN THE ELKINS DISTRICT COURT AND DELEGATING RESPONSIBILITY FOR COLLECTION OF DELINQUENT FINES TO A PRIVATE CONTRACTOR

WHEREAS, ACA Section 16-13-709 requires that the governing body of a City pass an Ordinance designating the official primarily responsible for collection of fines in the District Court and that delegating responsibility for collection of delinquent fines to a private contractor, be done by an Ordinance.

WHEREAS, the Elkins District Court, since 2009 has utilized the services of American Municipal Services (AMS) to collect delinquent fines and costs owed the Court.

WHEREAS, the Court has experienced great satisfaction with the services of AMS and received no valid complaints about AMS.

WHEREAS, the Washington County Quorum Court has authorized the Court Clerk to use the services of AMS to collect delinquent fines owed the County in the Elkins District Cou11.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF ELKINS, ARKANSAS, that:

Section I: The Court Clerk of the Elkins District Court shall be primarily responsible for the collection of fines assessed in such Court, and he/she may designate deputy court clerks or other city employees to assist as needed.

Section 2: With respect to delinquent fines which were assessed by the Elkins District Court, the Court Clerk is authorized to contract with American Municipal Services (AMS) for collection of such delinquent fines

Section 3: All collections of delinquent fines previously turned over to AMS for collection are hereby specifically ratified and confirmed to include any contract entered into with AMS which was executed in reliance on this Council’s vote recorded in the minutes of our July 16, 2009, Council meeting.
