A RESOLUTION AUTHORIZING THE CITY COUNCIL TO ALLOW BOND FORFEITURES, WRIT FEES, COPY FEES, CERTIFIED COPY FEES, INSUFFICIENT CHECK FEES, APPEAL TRANSCRIPT FEE, SUMMONS/SUBPOENA FEES COLLECTED BY THE COURT THAT ARE PAID TO THE CITY GENERAL FUND TO BE DESIGNATED AND ALLOCATED FOR THE USE BY THE DISTRICT COURT AT THE DISCRETION AND APPROVAL OF THE CHIEF DISTRICT COURT CLERK AND THE DISTRICT COURT JUDGE.
WHEREAS, the Washington County District Court – Elkins Department follows the procedures in Ark. Code Ann. §§ 16-84-201 and 16-84-202 collects the bonds forfeited when a defendant has been released on a district court warrant and a bond has been posted by a surety;
and
WHEREAS, the Washington County District Court – Elkins Department follows the procedures in Ark. Code Ann. § 16-17-126 and collects writs, filing and issuing fees, drawing and issuing or sealing a summons or subpoena; and
WHEREAS, the Washington County District Court – Elkins Department follows the procedures in Ark. Code Ann. § 16-17-124 and collects copy fees, certified copy fees, insufficient check fees, and appeal transcript fees; and
WHEREAS, all fees listed above shall be paid to the City of Elkins General Fund as directed by statue; and
WHEREAS, the City Council of Elkins authorizes that the monies listed above shall be used to pay for court to help fund the operation of the district court.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elkins as
That the City Finance Director is hereby directed to use the collected monies listed above, paid to the general fund, for use by the district court at the discretion and approval of the chief district court clerk.
