CITY OF ELKINS, WASHINGTON COUNTY, ARKANSAS
A RESOLUTION TO APPROVE THE MAYOR TO EXECUTE AN AGREEMENT BY AND BETWEEN THE CITY OF ELKINS AND THE CITY OF GOSHEN FOR THE PURPOSE OF SHARING DISTRICT COURT COSTS.
WHEREAS, Goshen has a police department (the “Goshen Police Department”) but does not operate its own District Court, however the City of Elkins operates a District Court in close proximity to Goshen; and
WHEREAS, Goshen wishes to have cases generated by the Goshen Police Department prosecuted through the Washington County District Court, Elkins Division (the “Elkins District Court”); and
WHEREAS, Ark. Code Ann. § 16-17-1203 requires that in order for Goshen to prosecute the cases generated by the Goshen Police Department in the Elkins District Court, a written agreement must be entered into between the governing bodies of Goshen and Elkins, which are the political subdivisions that contribute to the operational expenses of the Elkins District Court and the financial contribution by Goshen to the Elkins District Court shall be by agreement as set forth in Ark. Code Ann. § 16-17-1203(a)(1)(B); and
WHEREAS, in order for Goshen to have cases generated by the Goshen Police Department prosecuted through the Elkins District Court, an agreement between the cities, which sets forth the terms under which the City of Goshen and the City of Elkins will share district court costs will be executed by both cities, with approval of this City Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF ELKINS, that the Mayor of Elkins, Arkansas, is hereby authorized to execute the Agreement with any changes he deems necessary and all further action which may be necessary in order to carry out and perform the purposes and intents of this Resolution and all actions taken by the Mayor in connection therewith are hereby approved, confirmed and ratified.
