AN ORDINANCE ACCEPTING A NEW ADDITION TO THE CITY OF ELKINS, ARKANSAS, TO BE KNOWN AS STOKENBURY FARM SUBDIVISION, AN ADDITION TO THE CITY OF ELKINS, ARKANSAS, AND DECLARING AN EMERGENCY TO EXIST
THAT WHEREAS, there has been duly presented to the Elkins’ Planning Commission, a final pl[\t of certain land in the City of Elkins, Washington County, Arkansas, being more particularly described as follows, to-wit:
A PART OF THE NORTH HALF OF THE SOUTHEAST QUARTER OF SECTION 35, TOWNSHIP 16 NORTH, RANGE 29 WEST, WASHINGTON COUNTY, ARKANSAS BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: .
BEGINNING AT A FOUND IRON PIN FOR THE NORTHWEST CORNER OF THE NORTHWEST QUARTER OF THE SOUTHEAST QUARTER, THENCE S 89°52’16″E 1404.03 FEET TO A FOUND IRON PIN. THENCE S32°55’49″E 1552.71 FEET TO A SET IRON PIN IN A FENCE LINE, THENCE S89°26’48″W 453.82 FEET TO A SET IRON PIN IN A FENCE LINE. THENCE S89°07’39″W 808.92 FEET TO A SET IRON PIN IN A FENCE LINE; THENCE N89°48’16″W 340.00 FEET TO A SET IRON PIN IN A FENCE LINE, THENCE N75°36’56″W 29.67 FEET TO A SET IRON PIN IN A FENCE LINE, THENCE N89°5l ’04″W 433.36 FEET TO A SET IRON PIN IN STOKENBERRY ROAD, THENCE N05°32’54″W 250.71 FEET TO A SET IRON PIN, THENCE N06°16’53″W 146.63 FEET TO A SET IRON PIN. THENCE Nl0°03’21″W 131.43 FEET TO A SET IRON PIN, THENCE N 16°46’40″W 193.17 FEET TO A SETIRON PIN, THENCE N 17°37’33″W 104.86 FEET TO A SET IRON PIN, THENCE N 19°51’43″W 74.94 FEET TO A SET IRON PIN, THENCE LEAVING SAID CENTERLINE N 00°21’41 “E 433.36 FEET TO THE POINT OF BEGINNING CONTAINING 52.94 ACRES, MORE OR LESS. SUBJECT TO ANY RIGHT OF WAYS OR EASEMENTS OF RECORD OR FACT.
AND WHEREAS, the Planning Commission on October 5 2006, approved the final plat presented by Petitioner and has approved the dedication of streets, rights-of-way and utility easements shown upon said final plat; and, the Planning Commission now joins with the said Petitioner in requesting the City Council to accept said Stokenbury Farm Subdivision, as an addition of the City of Elkins, Arkansas;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELKINS, ARKANSAS:
Section 1: Development of this area of Elkins is vital to continued growth of the City.
Section 2: That Stokenbury Farm Subdivision, as shown on the final plat thereof which was approved by the Elkins Planning Commission, a copy of which is attached to this Ordinance and made a part hereof as though set out herein word for word, be and the same is hereby accepted by the City of Elkins, Washington County, Arkansas, and the City hereby accepts for the use and benefit to the public, the dedications contained therein of the streets, rights-of-way and utility easements.
BE IT FURTHER ORDAINED BY THE CITY COUNCIL FOR THE CITY OF ELKINS, THAT immediate passage and implementation of this Ordinance is necessary for the unchecked development of this area ofthe City, and for the efficient administration of City business and to preserve the public peace, health, safety and welfare of the citizens of Elkins, Arkansas, an emergency is hereby declared, and therefore, this Ordinance shall be in full force and effect from and after its passage and approval.
