AN ORDINANCE REPEALING ORDINANCE 06-17-2008B AND DECLARING AN EMERGENCY TO EXIST.
WHEREAS, Ordinance 06-17-2008B was passed on June 17, 2008, in anticipation of calling a special election and enacting a 2d penny sales tax to pay off water and sewer improvement bonds. WHEREAS, the newspaper publication of the ordinance failed to comply with ACA§7-5- 103(b) (6) NOW, THEREFORE, BE IT ORDAINED by the City Council of Elkins, Arkansas, That:
SECTION 1: Ordinance No. 06-17-2008B is hereby repealed in its entirety. SECTION 2: In order to avoid confusion with the Washington County Election Commission, the Arkansas Department of Finance and Administration and other government offices and officials it is critical to the passage of a 2d penny sales tax and issuance of the water and sewer improvement bonds that this ordinance be repealed immediately, insofar as the immediate commencement of water and sewer improvements are necessary to provide safe drinking water to city residents and visitors, the health, safety and welfare of Elkins’ residents and visitors being at risk, therefore an emergency is hereby declared and this ordinance shall be effective immediately upon its passage and approval. PASSED AND APPROVED this 7th day of July, 2008.
