AN ORDINANCE AMENDING ELKINS ORDINANCE NO. 03-21-2013B, REGULATING SALES OR SOLICITATION AT PRIVATE RESIDENCES.
WHEREAS, Ordinance No. 03-21-2013B established a process by which residents of the City of Elkins can obtain “No Soliciting/No Peddling” decals to preserve the peace and sanctity of their residences;
WHEREAS, Ordinance No. 03-21-2013B also established a registration procedure for legitimate door-to-door solicitors and peddlers so as to protect them from others who would disparage the reputation of legitimate solicitors and peddlers;
WHEREAS, Ordinance No. 03-21-2013B, as experience has shown, needs to be further refined to better accomplish its legitimate purposes and goals;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF ELKINS, ARKANSAS, that:
Section 1: As of the effective date of this Ordinance, Section 9, subsection (b) of Ordinance No. 03-21-2013B is amended to read as follows:
“b) As soon as practical after the passage of the resolution setting the hearing date and, in any event, not less than ten (10) business days prior to the hearing date, a notice of the hearing, along with a copy of the resolution setting the hearing date, shall be served by certified mail with return receipt requested, to the person holding the Principal Permit and/or the person holding the Solicitor/Peddler permit at the address shown on the applicable permit application. Such notice and resolution shall also be hand-delivered to the permittee at the address shown on the permit application, if the person is present at a location within the City. If the person is not present the notice and resolution shall be posted in a conspicuous location on the property at the address on the permit application.”
Section 2: In all other respects, Ordinance No. 03-21-2013B is not amended or modified and is hereby ratified and confirmed.
