AN ORDINANCE AMENDING THE ELKINS MUNICIPAL CODE, TITLE 2, AMENDING CHAPTER 2.56 AMENDING SUBSECTION 2.56.07 DATE OF APPEAL HEARING, REGARDING CERTAIN APPEAL PROCEDURES AND NOTICE.
WHEREAS the rights and procedures for appeals within the City of Elkins are not now entirely delineated, and
WHEREAS it is in the best interest of the City of Elkins to clarify appeal rights and provide a mechanism for appeal procedures, and to provide Notice to all interested persons.
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELKINS THAT THE ELKINS MUNICIPAL CODE, TITLE 2, CHAPTER 2.56, SUBSECTION 2.56.07 BE AMENDED BY CHANGING 2.56.07 TO READ AS FOLLOWS:
2.56.07 Date of appeal hearing. The City Council shall hear a properly ftled appeal within Thirty. (30) calendar days of Notice of Appeal unless the time is mutually extended by the City Council and the appellant. The City shall cause a copy of the Notice of Appeal to be mailed via firstclass mail to all persons who appeared and spoke previously in regard to the subject of the appeal; furthermore, notice of the hearing by the City Council of the appeal shall be published in a newspaper of general circulation at least once no less than ten (1 0) days prior to the hearing of such appeal.
