AN ORDINANCE DEANNEXING LANDS OF JACK AND RADA CARTER ANNEXED BY ORDINANCE 10-18-2007 A
WHEREAS, Ordinance No. 10-18-2007 A annexed certain described lands belonging to Jack B. and Rada M. Carter and Mary Louise Carter.
WHEREAS, Jack B. and Rada M. Carter and Mary Louise Carter have requested deannexation of their land pursuant to ACA § 14-40-608.
WHEREAS, it appears that the Carter land still forms the boundary of the City of Elkins, that no municipal utility services have been provided to the Carter land and that less than three<(3) years have passed since the annexation.
BE IT ORDAINED BY THE CITY COUNCIL OF ELKINS, ARKANSAS, That,
Section 1: That the following described lands, among others, were annexed to the City of Elkins, AR, by Ordinance No. 10-18-2007 A, to-wit:
All that is a part of Section 2, T15N R29W as described in Tract 2 as follows: A part of the SW1/4 of the SW1/4 of Section 1, T15N, R29W and a part of the SEl/4 of the SE1/4 of Section2, T15N, R29W all in Washington County, Arkansas and being described as follows: Commencing at the NE Comer of said SW1/4, SW1/4 thence S02 degrees l9’52″W373.61 feet to the NW Comer of Elkridge Plantation Subdivision, thence along the West Boundary Line of Elkridge Plantation Subdivision S03 degrees 08’07″W620.21feet, thence leaving said West Boundary Line N87 degrees l2’32″W671.87 feet to the P.O.B. Thence S02 degrees 42′.05″W92.78feet thence N88 degrees24’30″W632.81feet, thence N88 degrees 24’11 “W332.14 feet, thence N02 degrees57’55″E273.15feet, thence S87 degrees28’50″E 550.10 feet, thence N02 degrees 34’34″E148.44 feet, thence S87 degrees 25’26″E413.74 feet, thence S02 degrees 42’05″W 312.80 feet to the P.O.B: containing 7.28 acres more or less subject to easements and right of way of record.
Section 2: That the lands described in Section 1 above are hereby deannexed from the City of Elkins and are hereafter detached from the City of Elkins pursuant to ACA § 14-40- 608 at the request of Jack B. and Rada M. Carter and Mary Louise Carter.
