AN ORDINANCE REPEALING ORDINANCE NO. 07-15- 2010, AND AMENDING CHAPTER 5.12, SECTION 5.12.02 OF THE ELKINS MUNICIPAL CODE AND FOR OTHER PURPOSES.

WHEREAS, Chapter 5.12 of the Elkins Municipal Code (EMC hereinafter) makes reference in several sections to "city requirements" and "city qualifications" and words of similar import, no section of such Chapter defines or explains such term/terms.

WHEREAS, it is necessary to require solid waste haulers to meet certain standards to protect citizens, residents and visitors to the City.

BE IT ORDAINED BY THE CITY COUNCIL OF ELKINS, ARKANSAS, that,

Section 1: Section 5.12.02 entitled Solid Waste Definitions of Chapter 5.12, is hereby amended by adding as the second entry the following:

"City requirements/qualifications: each solid waste contractor/hauler who collects, hauls or disposes of solid waste generated in the City shall have:

a) commercial waste hauler license issued by the State of Arkansas; b) automobile liability insurance policy in amount not less than $500,000.00/$1 ,000,000.00; c) workers compensation coverage for all employees/workers; d) general liability policy in minimum amount of $1 ,000,000.00; e) contract with licensed landfill/disposal site; f) all licenses, permits, or other authorizations required by State or Federal authorities.

And shall provide proof of the foregoing to the City prior to commencement of hauling or collection of solid waste in Elkins".

Section 2: This amendment shall apply to all solid waste contractors, haulers and collectors operating within the City after its effective date.

Section 3: Ordinance No. 07-15-2010 is hereby repealed.
