AN ORDINANCE AMENDING TITLE 2, CHAPTER 2.52, SECTION 2.52.01, PARAGRAPH D OF THE ELKINS MUNICIPAL CODE CONCERNING PRE EMPLOYMENT PHYSICALS AND OTHER MATTERS.

WHEREAS, in an effort to protect prospective employees and ascertain that they are capable of performing jobs that are physically demanding it is necessary to make physicals for certain new hires mandatory.
BE IT ORDAINED BY THE CITY COUNCIL OF ELKINS, ARKANSAS, That,
Section 1: That from and after the effective date hereof paragraph D of Section 2.52.01 of Chapter 2.52 of Title 2 of the Elkins Municipal Code is hereby amended as set forth in Section 2 hereof.
Section 2: Said paragraph D is amended by changing the period (.) after the first sentence to a comma (,) and adding the following:
“however, such pre-employment physicals shall be mandatory for all full or part-time positions in the water and sewer department, the street department, the parks/recreation department and for animal control officers except for purely office or clerical employees in these departments.”
Section 3: Paragraph D of Section 2.52.01 of Chapter 2.52 of Title 2 ofthe Elkins Municipal Code is not amended or changed except as hereinabove specifically stated and said chapter is hereby ratified and confirmed.
