AN ORDINANCE TO ADOPT VARIOUS STANDARD CODES RELATING TO CONSTRUCTION PRACTICES AND INSPECTION ACTIVITIES WITHIN THE CITY OF ELKINS AND ENFORCEMENT OF CONSTRUCTION PROVISIONS AS PROVIDED IN SAID CODES; AND FOR OTHER PURPOSES.
Note: This ordinance is superseded by ORDINANCE 11-15-12
WHEREAS, it is the desire of the City of Elkins to adopt, in all respects the various standard Codes relating to amusement devices, building, fire prevention, gas, housing, electrical, life safety, accessibility, mechanical, plumbing, existing buildings and swimming pools, and;
WHEREAS, the adoption of these Codes is done to facilitate proper inspection activities by the City of Elkins relating to construction and maintenance of buildings within said City of Elkins and relating to public safety, health and the general welfare of residents and visitors.
NOW, THEREFORE, BE IT ORDAINED BY the City Council of Elkins, Arkansas:
SECTION I: The following Codes are hereby adopted by reference as though set forth herein word for word:
Building: Arkansas Fire Prevention Code – 2000 International Building Code with state supplement as revised or amended.
2003 International Residential Code for One and Two family Dwellings;
Mechanical: 2003 Arkansas Mechanical Code – 2000 International Plumbing Code with state amendments as revised or amended;
Plumbing: 2003 Arkansas State Plumbing Code – 2000 International Plumbing Code with state amendments as revised or amended;
Electrical: 2005 National Electrical Code – NFPA 70 National Electrical Code;
Gas: 1995 Arkansas State Gas Code;
Fire Prevention: Arkansas Fire Prevention Code – 2000 International Fire Code with state supplement;
Life Safety: Arkansas Fire Prevention Code – 2000 International Fire Code with state supplement;
Accessibility: Arkansas Fire Prevention Code – 2000 International Building Code with state supplement, and;
Existing Buildings: 2003 International Existing Building Code.
SECTION 2: BE IT FURTHER ORDAINED BY the City Council of Elkins, Arkansas that any matters in said Codes which are contrary to existing provisions of Elkins Municipal Code shall prevail and to that extent those provisions in the Elkin’s Municipal Code to the contrary are hereby repealed in that respect only.
SECTION 3: BE IT FURTHER ORDAINED that within said Codes, when reference is made to the duties of a certain official named therein, that designated official of the City of Elkins who had duties corresponding to those of the named official in said Code shall be deemed to be the responsible official insofar as enforcing the provisions of said Codes are concerned.
SECTION 4: That the amendments and updates to the aforesaid Codes, as published by the respective authorities, are also hereby adopted effective with the date that a copy of each such update or amendment is available to the public at Elkin’s City Hall.
