AN ORDINANCE REPEALING ORDINANCE NO. 12-03- 2009B, AND AMENDING TITLE 10, CHAPTER 1 0.08, SECTION 10.08.02, SUBPARAGRAPH D OF THE ELKINS MUNICIPAL CODE, EFFECTIVELY RAISING THE RATES TO BE CHARGED FOR WATER CONNECTION FEES AND FOR OTHER PURPOSES.

WHEREAS, technological advances have enabled the Elkins Water and Sewer Department to install a system to read the meters which measure water usage by its customers via radio which will save time and labor.

WHEREAS, this advance will require the replacement of all existing meters in use in the City with a new more expensive and more complicated meter.

WHEREAS, the cost to replace all existing meters will have to be borne by the Water and Sewer Department customers and it is critical to contain those costs by immediately requiring new customers to install the new type meters at the time of initial connection.

BE IT ORDAINED BY THE CITY COUNCIL OF ELKINS, ARKANSAS, That:

SECTION 1: Effective with the passage of this Ordinance subsection D of Section 10.08.02 Water Rates, of Chapter 10.08 of Title 10 of the Elkins Municipal Code shall read as follows:

D. Tapping Fee. There shall be a tapping fee in the amount equal to the actual cost to the city or Seven Hundred Dollars ($700.00), whichever is greater, for every water customer who connects with the system.

SECTION 2: That in order to place the expense of adopting the new technology on the Water and Sewer Department customers who will benefit therefrom, it is necessary to put this new fee into effect in regard to all new connections to the system and in all other respects

Section 10.08.02 is ratified and confirmed.

Section 3: Ordinance No. 12-03-2009B is hereby repealed.
