AN ORDINANCE REPEALING ORDINANCES 05-15-2008A AND 05-15- 2008B AND DECLARING AN EMERGENCY TO EXIST.

WHEREAS, Ordinances 05-15-2008A and 05-15-2008B were passed on May 15, 2008, in anticipation of calling a special election and enacting a 2d penny sales tax to pay off water improvement bonds.

WHEREAS, bond counsel has recommended that a single election be held which both approves the issuance of the bonds and enacts a 2d penny sales tax.

NOW, THEREFORE, BE IT ORDAINED by the City Council of Elkins, Arkansas, That:

SECTION 1: Ordinances No. 05-15-2008A and 05-15-2008B are hereby repealed in their entirety.

SECTION 2: In order to avoid confusion with the Washington County Election Commission, the Arkansas Department of Finance and Administration and other government offices and officials it is critical to the passage of a 2d penny sales tax and issuance of the water improvement bonds that these two ordinances be repealed immediately, in so far as the immediate commencement of water improvements are necessary to provide safe drinking water to city residents and visitors, the health, safety and welfare of Elkins’ residents and visitors being at risk, therefore an emergency is hereby declared and this ordinance shall be effective immediately upon its passage and approval.
