AN ORDINANCE ACCEPTING A NEW ADDITION TO THE CITY OF ELKINS, ARKANSAS, TO BE KNOWN AS MILLER’S CREEK SUBDIVISION, AN ADDITION TO THE CITY OF ELKINS, ARKANSAS, AND DECLARING AN EMERGENCY TO EXIST
THAT WHEREAS, there has been duly presented to the Elkins’ Planning Commission, a final plat of certain land in the City of Elkins, Washington County, Arkansas, being more particularly described as follows, to-wit:
PART OF THE SOUTHWEST QUARTER (SWl/4) OF THE NORTHWEST QUARTER (NWl/4) OF SECTION TWENTY-SEVEN (27) AND A PART OF THE NORTHEAST QUARTER (NEl/4) OF SECTION TWENTY-EIGHT (28), ALL IN TOWNSHIP SIXTEEN (16) NORTH, RANGE TWENTY NINE (29) WEST OF THE FIFTH PRINCIPAL MERIDIAN, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
BEGINNING OF THE SOUTHWEST CORNER OF THE SOUTHWEST QUARTER (SW1/4) OF THE NORTHWEST QUARTER (NWl/4) OF SAID SECTION TWENTY-SEVEN (27), SAID POINT BEING A SET ALUMINUM CAPPED Y,” IRON REBAR; THENCE NORTH 01 °30’19” EAST A DISTANCE OF 414.98 FEET TO THE POINT OF BEGINNING; THENCE NORTH 48°15’57” WEST 120.81 FEET; THENCE NORTH 02°00’28” EAST 169.32 FEET; THENCE NORTH 45°33’28” EAST 95.44 FEET; THENCE SOUTH 52°32’55” EAST 90.35 FEET; THENCE NORTH 15°41’21” EAST 22.58 FEET; THENCE NORTH 21 °56’30” EAST 115.28 FEET; THENCE NORTH 40°21’42” EAST 106.87 FEET; THENCE NORTH 59°55’59” EAST 8.78 FEET; THENCE SOUTH 01 °20’29″WEST 42.98 FEET; THENCE SOUTH 88°39’31” EAST 40.00 FEET; THENCE SOUTH 01 °20’29” WEST 434.04 FEET; THENCE NORTH 88°39’31” WEST 180.44 FEET; THENCE SOUTH 85°25’11” WEST 30.17 FEET TO THE POINT OF BEGINNING. CONTAINING 2.38 ACRES MORE OR LESS. SUBJECT TO ALL EASEMENTS AND/OR RIGHT-OF-WAYS RECORDED OR UN-RECORDED.
AND WHEREAS, the Planning Commission on June 4, 2007, approved the final plat presented by Petitioner and has approved the dedication of streets, rights-of-way and utility easements shown upon said final plat; and, the Planning Commission now joins with the said Petitioner in requesting the City Council to accept said Miller’s Creek Subdivision, as an addition of the City of Elkins, Arkansas;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL’ OF THE CITY OF ELKINS, ARKANSAS:
Section 1: Development of this area of Elkins is vital to continued growth of the City.
Section 2: That Miller’s Creek Subdivision, as shown on the final plat thereof which was approved by the Elkins Planning Commission, a copy of which is attached to this Ordinance and made a part hereof as though set out herein word for word, be and the same is hereby accepted by the City of Elkins, Washington County, Arkansas, and the City hereby accepts for the use and benefit to the public, the dedications contained therein of the streets, rights-of-way and utility easements.
BE IT FURTHER ORDAINED BY THE CITY COUNCIL FOR THE CITY OF ELKINS, THAT immediate passage and implementation of this Ordinance is necessary for the unchecked development of this area of the City, and for the efficient administration of City business and to preserve the public peace, health, safety and welfare of the citizens of Elkins, Arkansas, an emergency is hereby declared, and therefore, this Ordinance shall be in full force and effect from and after its passage and approval.
