A RESOLUTION TO DEDICATE A PORTION OF THE ONE CENT SALES AND USE TAX APPROVED BY VOTERS ON JANUARY 25, 2000, TO THE STREET FUND
WHEREAS, on January 25, 2000 voters of Elkins passed and approved a one cent sales and use tax with 33% dedicated to the Elkins Fire Department and 67% going to the General Fund of the City.
WHEREAS, Ordinance 6-15-2000, called a special election for the purpose for pledging 67% of the January 25, 2000, one cent sales and use tax to the retirement of a $600,000.00 bond issue which proceeds were used for constructing and improving streets in the City.
WHEREAS, upon retirement of the $600,000.00 in street bonds the 67% of the January 25, 2000, one cent sales and use tax again went into the General Fund of the City.
WHEREAS, there are several streets and roads within the City which need attention which costs will exceed the current funds available to the Street Department.
WHEREAS, the City's financial condition has improved over the last several years with several debts being retired and the general fund appears to be healthy enough to once again redirect that portion (67%) of the January 25, 2000 one cent sales and use tax to the Street Department.
BE IT RESOLVED BY THE CITY COUNCIL OF ELKINS, ARKANSAS, That:
Section 1: Effective the 1st day of July, 2013, the proceeds received by the City from the Arkansas Department of Finance and A ~nistration representing the 67% of the January 25 2000, one cent sales and use tax shall be placed in the City Street Fund for use in constructing and improving streets and roads within the City.
Section 2: This Resolution shall apply only to those specified proceeds as actually received by the City and is not subject to anticipation.
