A RESOLUTION AUTHORIZING EXECUTION OF A QUIT CLAIM DEED CONVEYING PROPERTY IN MILLER'S 1WEADOW SUBDIVISION TO THE SUCCESSOR OF THE DEVELOPER
WHEREAS, Miller's Meadow Subdivision was being planned, developed and readied for lot sales in 2004, 2005 and 2006;
WHEREAS, a tract of land 0. 76 acre in size 1\lls going to be com eyed to the City by the developer with a reverter clause in the event the City failed to maintain the land;
WHEREAS, the subdivision has not built out as anticipated and the 0.76 acre has been left pretty much undisturbed along with many of the unsold lots;
WHEREAS, the City has no current or foreseeable need for the 0.76 acre tract and there are no future plans to utilize or develop the. tract by the City;
WHEREAS, the City is having difficulty determining ifthe 0.76 acre tract was ever validly conveyed to the City; ·
WHEREAS, the City Administration has proposed issuing a quit claim deed to convey the 0. 76 acre to the current owner of the unsold lots.
BE IT RESOLVED BY THE CITY COUNCIL OF ELKINS, ARKANSAS, That;
Section 1: The reconveyance to the current owner of the unsold lots in Miller's Meadow Subdivision is in keeping with the agreement/understanding between the City and the original developer of the land.
Section 2: The Mayor and Recorder-Treasurer are hereby authorized and directed to execute and deliver the original of the Quitclaim Deed (pursuant to the copy attached hereto) conveying to the current owner of the unsold lots in Miller's Meadow Subdivision any interest the City has in such 0. 76 acre Tract.
