A RESOLUTION AUTHORIZING THE MAYOR AND RECORDERTREASURER OF THE CITY OF ELKINS TO ACCEPT A SETTLEMENT ON BEHALF OF THE CITY OF ELKINS WITH DR. SON AL BHAKTA.
Whereas, in 2004, Dr. Bhakta was admitted into the University of Arkansas for Medical Sciences program via the Community Match Loan Scholarship Program (Act 1114 of 1995) (hereinafter referred to as "the Program") which created obligations on Dr. Bhakta upon her successful licensure to practice medicine in Arkansas.
Whereas, Elkins participation in the Program was fully funded by a third party and public funds were not committed nor utilized in meeting Elkins' obligations.
Whereas, Dr. Bhakta has completed her UAMS course work and her residency program and is fully licensed to practice medicine in this State.
Whereas, unknown to the Elkins City Council in 2010 certain commitments were made to Dr. Bhakta by Mayor Ladyman which caused her to believe she was released from her obligations of the Program to Elkins.
Whereas, Dr. Bhakta acted upon that belief and made a contractual commitment to practice medicine other than in Elkins.
Whereas, Dr. Bhakta now finds herself with commitments to the Program, Elkins and an employer that can't all be met.
Whereas, Elkins finds that the anticipated establishment of a full-time medical practice within the City by Dr Bhakta won't occur as a result of the correspondence between Mayor Ladyman and Dr. Bhakta.
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ELKINS,
ARKANSAS, that the Mayor and Recorder-Treasurer are hereby authorized to accept the sum of $25,000.00 from Dr. Bhakta as full settlement of all claims either Elkins or Dr. Bhakta may have one against the other as a result of participation in the Program, and to issue a letter/release as maybe necessary to evidence such accord and satisfaction. This council will determine how to utilize the aforesaid sums at a later date.
