A RESOLUTION TO APPROVE AND AUTHORIZE RENEW AL OF THE CONTRACT FOR TRASH COLLECTION AND RECYCLING AND TO APPROPRIATE MONEY TO ACCOMPLISH SAME
WHEREAS, the most recent City of Elkins' contract for solid waste collection expired December 31, 2010.
WHEREAS, the City considered advertising for proposals from trash collection services and going through a bid process.
WHEREAS, the City Council upon the recommendation of the Water and Sewer Committee based upon very good past working relations with Roll-Off Services, Inc., determined that a renewal of the existing contract was most advantageous to the City and its residents.
WHEREAS, this is a vital service to the City and its residents, and greatly impacts the health and welfare of our citizens.
WHEREAS, it is necessary that the customers who utilize the trash collection services pay the expenses of such.
WHEREAS, Deffenbaugh ROS Acquisition, LLC, which has changed its name to Deffenbaugh of Arkansas, LLC, acquired the assets of and retained the employees of Roll-Off Services, Inc.
WHEREAS, Resolution 2011-10 was repealed due to the need to add a provision to the agreement concerning insurance coverages and the like.
NOW, THEREFORE, BE IT RESOLVED BY THE ELKINS CITY COUNCIL,
following debate and discussion, that the Contract for Services attached as Exhibit A should be entered into on behalf of the City of Elkins by the Mayor and City Clerk pursuant to the authority of this City Council resolution. This Resolution supersedes Resolution 2011-08 and the attached contract replaces the contract approved by and attached to Resolution 2011-08. The attached contract is hereby ratified and confirmed and it is hereby decided and determined that at such time and from time to time, as the contract is performed and a proper bill from the Contractor received, then Elkins Water and Sewer Department shall, from the fees collected for such services, pay the contract price for the services received pursuant to said Contract.
