A RESOLUTION SELECTING AND AUTHORIZING
EMPLOYMENT OF BOND COUNSEL FOR THE PHASE II
WATER LINE REPLACEMENT AND WATER METER
Whereas, the Water and Sewer Committee has recommended that the City should obtain
the services of Hon. David F. Menz, of Williams & Anderson, attorneys, as bond counsel for
purposes of completion of the financing of the Phase II Waterline Replacement and Water Meter
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ELKINS,
Section 1: David F. Menz, attorney at Law of the Williams & Anderson firm in Little
Rock is hereby selected and employed as bond counsel to represent the City of Elkins for the
financing of Phase II of the Waterline Replacement and Water Meter Improvement Project
(hereinafter the Project) in regard to the Arkansas Natural Resources Commission and others
involved with the Project and its financing.
Section 2: The Mayor, Recorder-Treasurer and/or the designated representative of
the Water and Sewer Committee are authorized to execute such agreements or other documents
required to obtain the services of Mr. Menz and to pay such fees and expenses as billed in
accordance with such agreement from funds provided by the Project financing, or such other
funds as may be advanced by either the City or the Water and Sewer Department in anticipation
of the Project financing.
