AN ORDINANCE TO AMEND THE ZONING DISTRICT CLASSIFICATION AND BOUNDARIES REGARDING PROPERTY IDENTIFIED IN REZONING PETITION OF GERALD BOWMAN APPROVED BY ELKINS PLANNING COMMISSION ON FEBRUARY 4, 2008.

WHEREAS, the Planning Commission on February 4, 2008, passed the Rezoning Petition of Gerald Bowman and recommended to the City Council passage of an ordinance to rezone the described property from R-1 to C-2.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELKINS, ARKANSAS:

SECTION I: That the zone classification of the following described property be changed from R-1 to C-2:

A 3.89 acre part of the Southeast Quarter (SEI/4) of the Northeast Quarter (NEI/4) of Section Twenty-seven (27), Township Sixteen (16) North, Range Twenty-nine (29) West of the Fifth Principal Meridian, situated in the City of Elkins, Washington County, Arkansas Being more particularly described as follows:

Beginning at an iron pin in the centerline of Harris Road marking the Southwest corner ofthe said SEI/4 of the NEI/4 of Section 27 T-16-N R-29-W; thence NO oo07’28″W a distance of 663.96′ to an iron pin; thence S89°5l ’22″E a distance of 153.56′ to an iron pin; thence S07°28’41 “E a distance of 13.71′ to an iron pin; thence S66°3l ’34″E a distance of 126.77′ to an iron pin; thence N20053’36″E a distance of 12.32′ to an iron pin; thence S66°37’48″E a distance of 94.17′ to an iron pin; thence S 19°51 ’03 “W a distance of 608. 77′ to an iron pin in the centerline of Harris Road thence S89°36’51 “W along the centerline of Harris Road 154.30′ to an iron pin at the POINT OF BEGINNING, containing 169646.48 square feet or 3.89 acres more or less. Subject to the Right of Way of Harris Road and all existing Easements, Right-of-Ways, restrictions.

SECTION 2: That the official Zoning District’s map of the City of Elkins, Arkansas is hereby amended to reflect the zoning change in Section I above.
