AN ORDINANCE ACCEPTING A NEW ADDITION TO THE CITY OF ELKINS, ARKANSAS, TO BE KNOWN AS ELKRIDGE PLANTATION SUBDIVISION, AN ADDITION TO THE CITY OF ELKINS, ARKANSAS, AND DECLARING AN EMERGENCY TO EXIST
THAT WHEREAS, there has been duly presented to the Elkins’ Planning Commission, a final plat of certain land in the City of Elkins, Washington County, Arkansas, being more particularly described as follows, to-wit:
A PART OF THE SEl/4 OF THE SW1/4 OF SECTION I, TOWNSHIP 15 NORTH, RANGE 29 WEST, WASHINGTON COUNTY, ARKANSAS, MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING AT THE SOUTHEAST CORNER OF SAID SE1/4 OF THE SW1/4; THENCE ALONG THE EAST LINE OF SAID SEl/4 OF THE SW1/4 N02°39’50″E 474.14 FEET; THENCE DEPARTING SAID EAST LINE N87°11’15″W 40.00 FEET TO AN IRON PIN FOUND ON THE WEST RIGHT-OF-WAY LINE OF SOUTH CENTER STREET (AR.HWY. 16) AND THE POINT OF BEGINNING; THENCE CONTINUING N87°11 ’15″W 250.40 FEET TO A FOUND IRON PIN; THENCE S02°39’50″E 150.00 FEET TO A FOUND IRON PIN; THENCE N87°13’16″W 1012.74 FEET TO A FOUND IRON PIN; THENCE N03°09’18″E 626.33 FEET TO A FOUND IRON PIN; THENCE S85°52’88″E 948.76 FEET TO A FOUND IRON PIN; THENCE N84°15’57″E 312.67 FEET TO THE WEST RIGHT-OF-WAY LINE OF SAID SOUTH CENTER STREET; THENCE ALONG SAID WEST RIGHT-OFWAY LINE S02°39’50″E 500.60 FEET TO THE POINT OF BEGINNING, CONTAINING 17.03 ACRES, MORE OR LESS, SUBJECT TO THE CITY OF ELKINS WATER LINE EASEMENT RUNNING NORTH-SOUTH ALONG THE EAST SIDE AND SUBJECT TO ANY EASEMENTS, COVENANTS OR RESTRICTIONS OF RECORD OR FACT.
AND WHEREAS, the Planning Commission on August 7, 2006, approved the final plat presented by Petitioner and has approved the dedication of streets, rights-of-way ‘and utility easements shown upon said final plat; and, the Planning Commission now joins with the said Petitioner in requesting the City Council to accept said Elkridge Plantation Subdivision,
as an addition of the City of Elkins, Arkansas;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELKINS, ARKANSAS:
Section 1: Development of this area of Elkins is vital to continued growth of the City.
Section 2: That Elkridge Plantation Subdivision, as shown on the final plat thereof which was approved by the Elkins Planning Commission, a copy of which is attached to this Ordinance and made a part hereof as though set out herein word for word, be and the same is hereby accepted by the City of Elkins, Washington County, Arkansas, and the City hereby accepts for the use and benefit to the public, the dedications contained therein of the streets, rights-of-way and utility easements.
BE IT FURTHER ORDAINED BY THE CITY COUNCIL FOR THE CITY OF ELKINS, THAT immediate passage and implementation of this Ordinance is necessary for the unchecked development of this area of the City, and for the efficient administration of City business and to preserve the public peace, health, safety and welfare of the citizens of Elkins, Arkansas, an emergency is hereby declared, and therefore, this Ordinance shall be in full force and effect from and after its passage and approval.
