City of Elkins, Arkansas City Council Meeting

TIME: 7:00 p.m.

DATE:May 20, 2010

PLACE: Elkins City Administration Building, Elkins, Arkansas Present: Mayor Jack Ladyman, Alderman Bonnie Wilcox, Alderman Terri Miller, Alderman Bruce Ledford, Alderman Lloyd Stith, Alderman Jeremy Stevens, Alderman Duane Foster and Attorney Danny Wright.

1. Mayor Jack Ladyman called a City Council Meeting of the City of Elkins at 7:00 p.m.

2. Mayor Ladyman led the invocation.

3. Susan Unger led the Pledge of Allegiance.

4. Recorder!Treasurer Sunny Ledford called roll: Alderman Lloyd Stith, Alderman Jeremy Stevens, Alderman Bonnie Wilcox, Alderman Bruce Ledford, Alderman Terri Miller and Alderman Duane Foster

5. Approval of 5/20/2010 minutes- Alderman Stevens made a motion to approve the minutes as presented. Alderman Miller seconded. Roll Call: (6/0) Motion Carried. 6. Department Reports- Updates on construction of library, update on Water Department meter reads and "warning" alarm for over-flows. 7. Unfinished Business a.)Ordinance 04/01/10 Concerning Deannexation of Carter Property on Hattabaugh Lane-Alderman Stevens made a motion to put Ordinance 04/01/10 on third reading by title only. Alderman Miller seconded the motion. Roll Call: (6/0) Motion Carried.

Alderman Stevens made a motion to approve third reading of Ordinance 04-01- 2010. Alderman Miller seconded. Roll Call: (6/0) Motion Carried.

8. a.) Resolution committing $150,000 to Expand City of Fayetteville Sewer Interceptor Line to Mally Wagnon Lift- Alderman Stith explained in depth and reported the Water & Sewer Committee is highly in favor. They voted on and passed approval of expansion.

Alderman Stevens made a motion to approve Resolution 2010-19. Alderman Miller seconded the motion. Roll Call: (6/0) Motion Carried. Mayor asks if we can apply the $50,000+ already paid in impact fees. Stith stated he thinks it should be worked out between Attorney Danny Wright and Steve Davis with the City of Fayetteville.

b.) Committee Appointments-Eric Terry-Streets Committee, Bill Epperson- Water and Sewer Committee, Keith Gazer- Parks Committee, Amy Gazer- Parks Committee. Alderman Stevens made a motion to approve the four committee appointments. Alderman Wilcox seconded the motion. Roll Call: (6/0) Motion Carried.

c.) Ordinance Establishing Inattentive Driving Violation- Alderman Stevens made a motion to put Ordinance 5-20-201 OA on first read by title only with below suggestions: Alderman Stevens suggests initial fine no less than $100 or greater than $150 for first offense. $150-200 for second offense and between $200-250 for third offense and possibility of must appear. Roll Call (2/4) Motion Failed.

d.) Noise Ordinance-Alderman Miller asked to review ordinance. Officers have responded to complaints at residence in question. Residents were given their final warning and will be ticketed for noise pollution as long as officer is able to hear the noise in question. To be discussed at meetings in future.

e.) Ordinance banning the sale and use of K2 in the city of Elkins-Alderman Stevens made a motion to put Ordinance 5/20/201 OA on first reading. Alderman Miller seconded the motion. Officer Rhodes approached the council in regards to the "synthetic marijuana" and has already had a student give some to him. He asked Elkins lead the charge for Washington County. Roll Call: (6/0) Motion Carried.

Alderman Stevens made a motion to approve first reading of Ordinance 5/20/201 OA Roll Call: (6/0) Motion Carried. Alderman Miller made a motion to put Ordinance 5/20/201 OA on second and third reading by title only. Alderman Wilcox seconded. Roll Call: (6/0) Motion Carried.

Alderman Miller made a motion to approve second and third reading of Ordinance 5/20/2010A. Alderman Stith seconded. Roll Call: (6/0) Motion Carried

b.) Review of 2009 Audit of Retired Firemen's Retirement Account

c.) Citizens Comments- Danny Wright presented options for our ordinance and suggestions to leave off part of section 9 and all of 11.

Alderman Stith made a motion to adjourn, seconded by Alderman Wilcox. Meeting adjourned at 8:45.
